Program Description:

Receiving notice of a lawsuit from a current or former employee can be overwhelming for any organization and business owner. HR professionals and Leadership play a crucial role in navigating this challenging situation and minimizing further risk. This session provides a practical roadmap for responding effectively to employee lawsuits, from the moment you receive notice to final resolution. Attendees will learn how to preserve critical evidence, collaborate with legal counsel, and maintain workplace morale while protecting the organization’s reputation.

Learning Objectives:

  1. Immediate Steps After Receiving a Complaint:
    Understand the critical first actions to take when notified of a lawsuit, including preserving relevant documentation, issuing legal holds, and communicating appropriately with stakeholders.
  2. Collaborating with Legal Counsel:
    Learn how to work effectively with attorneys to build a strong defense, provide essential information, and ensure compliance with court requirements.
  3. Maintaining Workplace Stability During Litigation:
    Explore strategies for addressing employee concerns, managing internal communications, and preventing retaliation or further claims while maintaining productivity and morale.

Presenter Bio:

David Miklas owns a Labor & Employment law firm and for 27 years he has practiced all types of labor and employment law exclusively representing Florida employers.

He has written hundreds of employment law articles, is the co-author for the premier legal textbook used by lawyers for Florida employment law, is a frequent employment law presenter and is a nationally recognized speaker and an invited guest lecturer addressing employment law and human resource issues with over thirty universities, including Harvard.

Mr. Miklas graduated from the University of Florida College of Law.
